PRIVATE EYE AND JERSEYGATE:

The Beginning of The End?

Private Eye magazine has published an article concerning events in Jersey. They examine one of the things that I exposed – and the consequent actions taken against me by what they describe as “the intensely political system of justice in Jersey”.  Even though you’re able to read that particular article here, taken from the current edition, I urge people to buy Private Eye. Not only is it often very funny – it is the journal to read if you want to understand what’s really going on in the dark underbelly of power in Britain.
Whether they open its pages in pleasure – or fear – everyone in the country who is seriously involved in politics or the media reads Private Eye.

That means it is a main source of hard-core information for everyone who has power over you.

The article is short – eight paragraphs; but what do those few elements mean?

How to understand the gravity of what is revealed?

Not all readers will be familiar with the true nature of ‘Politics’ – just as many readers won’t be familiar with the wholly corrupted power-structure of the British Channel Island of Jersey; a tiny island through which hundreds of billions of dollars pass each year – and in which there is no separation of powers – no independent judiciary - no checks and balances – and not even an independent prosecution system. Although situated in the seemingly “respectable” heart of Western Europe, this island – an off-shore “protectorate” of the British establishment in London – is virtually totally lawless.

In the coming months – just how lawless – is going to be revealed.

But perhaps you don’t want to wait that long? Perhaps you want to know the score – truly “understand” the situation - right now?

OK - I’m going to tell you a story.

Or rather – Wikipedia is going to recount some modern history to you.

I reproduce below some sections of the Wikipedia entry for the Watergate scandal.

As you read the quotes – I invite you to bear in mind certain key words and phrases that Watergate has in common with Jerseygate. For any thinking person – it’s all here; all you need to know:

It isn’t only those words that Watergate and Jerseygate share; the parallels between the two criminal enterprises are remarkable; extraordinarily close. Save for a few, key, differences.

As bad as it was, Watergate only involved illegal wiretapping, burglary, assault upon democracy, political espionage, bribery, abuse of Office, blackmail, abuse of power and perjury – for the “cause” of partisan political advancement.

Jerseygate - absolutely – parallels all of those actions and motives. But it’s worse.

When you’re reading the following quotes from Wikipedia - just imagine - if you can – how much worse Watergate would have been – if self-enrichment – the commercial racketeering of public Office – the outright theft of public money – child abuse - the use of the police force as a private army of burglars – misuse of the Criminal Offences Confiscation Fund - the criminal concealment of child-abuse – the criminal concealment of clinical murder – and the suborning of the judiciary - had been involved?

Imagine that – then you start to get close to understanding Jerseygate.

Wikipedia on Watergate; selected quotes:

“The Watergate scandal was a political scandal during the 1970s in the United States resulting from the break-in of the Democratic National Committee headquarters at the Watergate office complex in Washington, D.C. Effects of the scandal ultimately led to the resignation of the President of the United States, Richard Nixon, on August 9, 1974, the first and only resignation of any U.S. President. It also resulted in the indictment, trial, conviction and incarceration of several Nixon administration officials.
The affair began with the arrest of five men for breaking and entering into the Democratic National Committee headquarters at the Watergate complex on June 17, 1972. The FBI connected the payments to the burglars to a slush fund used by the 1972 Committee to Re-elect the President.....”


“.....The men who broke into the office were tried and convicted on January 30, 1973. After much investigation, all five men were directly, or indirectly, tied to the 1972 Committee to Re-elect the President (CRP, or sometimes pejoratively referred to as CReeP). The trial judge, John J. Sirica, suspected a conspiracy involving higher-echelon government officials. In March 1973, James McCord wrote a letter to Sirica, claiming that he was under political pressure to plead guilty and he implicated high-ranking government officials, including former Attorney General John Mitchell. His letter helped to elevate the affair into a more prominent political scandal.....”


“.....The unravelling of the cover-up began in the immediate aftermath of the arrests, the search of the burglars' hotel rooms, and a background investigation of the initial evidence, most prominently thousands of dollars in cash in their possession at the time of arrest. On June 19, 1972, it was publicly revealed that one of the Watergate burglars was a Republican Party security aide. Former Attorney General John Mitchell, who at the time was the head of the Nixon re-election campaign, denied any involvement with the Watergate break-in or knowledge of the five burglars. On August 1, a $25,000 cashiers check earmarked for the Nixon re-election campaign was found in the bank account of one of the Watergate burglars. Further investigation would reveal accounts showing that still more thousands had passed through their bank and credit card accounts, supporting their travel, living expenses, and purchases, in the months leading up to their arrests. Examination of the burglars' accounts showed the link to the 1972 Committee to Re-Elect the President, through its subordinate finance committee.....”

“.....The investigative finding, which cleared Bernard Barker’s bank of fiduciary malfeasance, led to the direct implication of members of the Committee to Re-Elect the President, to whom the checks had been delivered. Those individuals were the Committee Bookkeeper and its Treasurer, Hugh Sloan.
The Committee, as an organization, followed normal business accounting standards in allowing only duly authorized individual(s) to accept and endorse on behalf of the Committee any financial instrument created on the Committee’s behalf by itself, or by others. Therefore, no financial institution would accept or process a check on behalf of the Committee unless it had been endorsed and verified as endorsed by a duly authorized individual(s). On the checks themselves deposited into Bernard Barker’s bank account was the endorsement of Committee Treasurer Hugh Sloan who was duly authorized and designated to endorse such instruments that were prepared (by others) on behalf of the Committee.
But once Sloan had endorsed a check made payable to the Committee, he had a legal and fiduciary responsibility to see that the check was deposited into the account(s) which were named on the check, and for which he had been delegated fiduciary responsibility. Sloan failed to do that. He was confronted and faced the potential charge of federal bank fraud; he revealed that he had given the checks to G. Gordon Liddy and was directed by Committee Deputy Director Jeb Magruder and Finance Director Maurice Stans to do so.
On September 29, 1972 it was revealed that John Mitchell, while serving as Attorney General, controlled a secret Republican fund used to finance intelligence-gathering against the Democrats. On October 10, the FBI reported that the Watergate break-in was part of a massive campaign of political spying and sabotage on behalf of the officials and heads of the Nixon re-election campaign. Despite these revelations, Nixon's re-election campaign was never seriously jeopardized, and on November 7 the President was re-elected in one of the biggest landslides ever in American political history.....”

“.....The connection between the break-in and the re-election campaign committee was highlighted by media coverage. In particular, investigative coverage by Time, The New York Times, and especially The Washington Post, fueled focus on the event. The coverage dramatically increased publicity and consequent political repercussions. Relying heavily upon anonymous sources, Post reporters Bob Woodward and Carl Bernstein uncovered information suggesting that knowledge of the break-in, and attempts to cover it up, led deep into the Justice Department, the FBI, the CIA, and even the White House. Chief among the Post's anonymous sources was an individual they had nicknamed Deep Throat, who was much later (2005) revealed to be former Deputy Director of the FBI William Mark Felt, Sr.. It was Deep Throat who met secretly with Woodward, and told him of Howard Hunt’s involvement with the Watergate break-in, and that the rest of the White House staff regarded the stake in Watergate extremely high. Deep Throat also warned Woodward that the FBI wanted to know where he and the other reporters were getting the information which was uncovering even a wider web of crimes than first disclosed. In one of their last meetings, all of which took place at an underground parking garage somewhere in Washington DC at 2:00 AM, Deep Throat cautioned Woodward that he might be followed and not to trust their phone conversations.....”

“.....A taped conversation that was crucial to the case against President Nixon took place between the President and his counsel, John Dean, on March 21, 1973. In this conversation, Dean summarizes many aspects of the Watergate case, and then focuses on the subsequent cover-up, describing it as a "cancer on the presidency". The burglary team was being paid hush money for their silence and Dean states: "that's the most troublesome post-thing, because Bob [Haldeman] is involved in that; John [Ehrlichman] is involved in that; I am involved in that; Mitchell is involved in that. And that's an obstruction of justice." Dean continues and states that Howard Hunt is blackmailing the White House, demanding money immediately, and President Nixon states that the blackmail money should be paid: "…just looking at the immediate problem, don't you have to have –handle Hunt's financial situation damn soon? […] you've got to keep the cap on the bottle that much, in order to have any options." At the time of the initial congressional impeachment debate on Watergate, it was not known that Nixon had known and approved of the payments to the Watergate defendants much earlier than this conversation. Among later released recordings, Nixon's conversation with Haldeman on August 1, 1972 is one of several tapes that establishes this. Nixon states: "Well…they have to be paid. That's all there is to that. They have to be paid" During congressional debate on impeachment, those who believed that impeachment required a criminally indictable offense focused their attention on President Nixon's agreement to make the blackmail payments, regarding this as an affirmative act to obstruct justice as a member of the cover-up conspiracy.
Cox's refusal to drop his subpoena influenced Nixon to demand the resignations of Richardson and deputy William Ruckelshaus, on October 20, 1973, in a search for someone in the Justice Department willing to fire Cox. This search ended with Solicitor General Robert Bork. Though Bork believed Nixon's order to be valid and appropriate, he considered resigning to avoid being "perceived as a man who did the President's bidding to save my job." However, both Richardson and Ruckelshaus persuaded him not to resign, in order to prevent any further damage to the Justice Department. As the new acting department head, Bork carried out the presidential order and dismissed the special prosecutor. Allegations of wrongdoing prompted Nixon to famously state "I'm not a crook" in front of 400 Associated Press managing editors on November 17, 1973.
Nixon was compelled, however, to allow the appointment of a new special prosecutor, Leon Jaworski, who continued the investigation. While Nixon continued to refuse to turn over actual tapes, he agreed to release transcripts of a large number of them; Nixon cited the fact that any audio pertinent to national security information could be redacted from the released tapes.....”

“.....On March 1, 1974, former aides to the president, known as the "Watergate Seven" — Haldeman, Ehrlichman, Mitchell, Charles Colson, Gordon C. Strachan, Robert Mardian and Kenneth Parkinson — were indicted for conspiring to hinder the Watergate investigation. The grand jury also secretly named Nixon as an unindicted co-conspirator. John Dean, Jeb Stuart Magruder, and other figures had already pleaded guilty. On April 5, 1974, former Nixon appointments secretary Dwight Chapin was convicted of lying to the grand jury. Two days later, the Watergate grand jury indicted Ed Reinecke, Republican lieutenant governor of California, on three charges of perjury before the Senate committee.
Nixon's position was becoming increasingly precarious, and the House of Representatives began formal investigations into the possible impeachment of the president. The House Judiciary Committee voted 27 to 11 on July 27, 1974 to recommend the first article of impeachment against the president: obstruction of justice. The second (abuse of power) and third (contempt of Congress) articles were passed on July 29, 1974 and July 30, 1974, respectively.
On August 5, 1974, the previously unknown audio tape from June 23, 1972, was released. Recorded only a few days after the break-in, it documented Nixon and Haldeman meeting in the Oval Office and formulating a plan to block investigations by having the CIA falsely claim to the FBI that national security was involved. Haldeman introduces the topic as follows: "…the Democratic break-in thing, we're back to the–in the, the problem area because the FBI is not under control, because Gray doesn't exactly know how to control them, and they have… their investigation is now leading into some productive areas […] and it goes in some directions we don't want it to go." After explaining how the money from CRP was traced to the burglars, Haldeman explained to Nixon the coverup plan: "the way to handle this now is for us to have Walters [CIA] call Pat Gray [FBI] and just say, 'Stay the hell out of this …this is ah, business here we don't want you to go any further on it.'" President Nixon approved the plan, and he is given more information about the involvement of his campaign in the break-in, telling Haldeman: "All right, fine, I understand it all. We won't second-guess Mitchell and the rest." Returning to the use of the CIA to obstruct the FBI, he instructs Haldeman: "You call them in. Good. Good deal. Play it tough. That's the way they play it and that's the way we are going to play it."
Prior to the release of this tape, President Nixon had denied political motivations in his instructions to the CIA, and claimed he had no knowledge prior to March 21, 1973 of any involvement by senior campaign officials such as John Mitchell. The contents of this tape persuaded President Nixon's own lawyers, Fred Buzhardt and James St. Clair, "The tape proved that the President had lied to the nation, to his closest aides, and to his own lawyers – for more than two years." The tape, which was referred to as a "smoking gun", hampered Nixon politically. The ten congressmen who had voted against all three articles of impeachment in the committee announced that they would all support impeachment when the vote was taken in the full House.....”

“.....Charles Colson pleaded guilty to charges concerning the Daniel Ellsberg case; in exchange, the indictment against him for covering up the activities of the Committee to Re-elect the President was dropped, as it was against Strachan. The remaining five members of the Watergate Seven indicted in March went on trial in October 1974, and on January 1, 1975, all but Parkinson were found guilty. In 1976, the U.S. Court of Appeals ordered a new trial for Mardian; subsequently, all charges against him were dropped. Haldeman, Ehrlichman, and Mitchell exhausted their appeals in 1977. Ehrlichman entered prison in 1976, followed by the other two in 1977.
The effect on the upcoming Senate election and House race, only three months later, was significant. The Democrats gained five seats in the Senate and 49 in the House. Watergate was also indirectly responsible for changes in campaign financing. It was a driving factor in amending the Freedom of Information Act in 1974, as well as laws requiring new financial disclosures by key government officials, such as the Ethics in Government Act.....”

“.....Since Nixon and many senior officials involved in Watergate were lawyers, the scandal severely tarnished the public image of the legal profession. In order to defuse public demand for direct federal regulation of lawyers (as opposed to leaving it in the hands of state bar associations or courts), the American Bar Association (ABA) launched two major reforms. First, the ABA decided that its existing Model Code of Professional Responsibility (promulgated 1969) was a failure and replaced it with the Model Rules of Professional Conduct in 1983. The MRPC have been adopted in part or in whole by 49 states (and is being actively considered by the last one, California). Its preamble contains an emphatic reminder to young lawyers that the legal profession can remain self-governing only if lawyers behave properly. Second, the ABA promulgated a requirement that law students at ABA-approved law schools take a course in professional responsibility (which means they must study the MRPC). The requirement remains in effect.....”

“.....Meier told Donald that he was sure the Democrats would win the election because they had considerable information on Richard Nixon’s illicit dealings with Howard Hughes that had never been released, and that Larry O’Brien had the information. O’Brien, who had received $25,000 from Hughes, didn’t actually have any documents but Meier claims to have wanted Richard Nixon to think he did. It is only a question of conjecture then that Donald called his brother Richard and told him that Meier gave the Democrats all the Hughes information that could destroy him and that O’Brien had the proof. The fact is Larry O'Brien, elected Democratic Party Chairman, was also a lobbyist for Howard Hughes in a Democratic controlled Congress and the possibility of his finding about Hughes' illegal contributions to the Nixon campaign was too much of a danger for Nixon to ignore and O'Brien's office at Watergate became a target of Nixon's intelligence in the political campaign. This theory has been proposed as a motivation for the break-in.....”
There is, of course, a particularly fundamental difference between Watergate and Jerseygate in that Nixon didn’t – quite – have the power to decide not to investigate and prosecute himself – unlike Philip Bailhache, Michael Birt, William Bailhache and Tim le Cocq – the London appointed and protected Jersey officials at the heart of the scandal.

Those readers who are familiar with Watergate may remember some very famous quotes. For example, this from special Prosecutor Leon Jaworski:
“From Watergate we learned what generations before us have known; our Constitution works. And during the Watergate years it was interpreted again so as to reaffirm that no one - absolutely no one - is above the law.”
I hope that Jaworski was right in respect of the USA. In the coming months we will discover whether his assessment runs in the British sphere. Because as far as the British island of Jersey is concerned – ‘our “constitution” has not worked’.

The journalist who was most prominent in exposing the Watergate scandal was Bob Woodward, and it is difficult to avoid finding parallels with the work of today’s citizens’ media - and Jerseygate - when reading some of his quotations:
“Way before Watergate, senior administration officials hid behind anonymity.”

“The source known as Deep Throat provided a kind of road map through the scandal. His one consistent message was that the Watergate burglary was just the tip of the iceberg.”

“The fact of the Watergate cover-up is not nearly as interesting as the step into making the cover-up. And when you understand the step, you understand that Richard Nixon lied. That he was a criminal.”
There are a lot of “Richard Nixons” in Jerseygate – but most prominent amongst them are the London-appointed succession of Attorney Generals– not least William and Philip Bailhache.

For reasons that are going to become clear – they were behind the assault, aggravated burglary and theft conducted against me - as carried out by the States of Jersey police under the leadership of David Warcup and Mick Gradwell.

Private Eye – in the article quoted at the head of this posting - reports that part of the episode thus:
“This gave the Jersey authorities the excuse they needed to act against a thorn in their side. In an unprecedented move for alleged data protection offences, the police raided Syvret’s house without a warrant, seizing and copying papers and computer hard drives containing, among other things, confidential correspondence with his constituents and information on other Jersey scandals.”
The Jersey police – obeying the orders of a personally and professionally conflicted and compromised Attorney General– engaged in burglary – assault -illegal breaking and entering – the theft of the sacrosanct private communications between the Jersey public and their elected representatives.
As Senator Sam Ervin – Chairman of the Senate Watergate Committee observed: -
“If the many allegations made to this date are true, then the burglars who broke into the headquarters of the Democratic National Committee at the Watergate were, in effect, breaking into the home of every citizen.”
Jersey’s Attorney General, and a suborned police force – following the illegal suspension of Graham Power – mounting illegal raids - burglary, theft –political repression – against your democratically elected representatives – against you.
I genuinely wonder about the rationality of the Jersey oligarchs and their vassals.
It isn’t clear – even now – that they understand the territory they have chosen to occupy.

But even if they don’t recognise the terra damnata they’ve voyaged into and the gravity of their position – a lot of other people now do.

Lenny Harper under-estimated the lengths that some in the Jersey Establishment would go to, to prevent jusctice for the abuse victims.

One of the major differences between Watergate and Jersey-gate is "journalism." Woodward and Bernstein also had the backing of their newspaper who wanted to get to the truth.

What have we got in Jersey? Our mainstream media have made it abundantly clear that they are not interested in truth. They do as best they can to dis-credit anybody who is looking for the truth.

It is encouraging to know that outside media are taking notice of what's going on in this lawless island, they're just about the only hope we have left! As well as your court case(s).

Well certainly not investigative journalism of the Jersey 'cover-up' kind, but the facts are out there for all to see and it would not take too much effort to get this story and many others into such a publication.

Perhaps Mr Hislop would like some more good old Jersey stories? Not only would it boost his circulation figures, but give much needed publicity to the state this Island is in.

Incidentally it is a very good read.

If we had an independent and impartial media of our own we wouldn't have to rely on outside media to hold our goverment to account. Could somebody tell me where I can purchase a copy of private eye? I've tried in a number of places and they're all sold out.

Nice to see W H Smith handling Private Eye. I remember the campaign many decades ago to get them to stock the magazine, which they were adamantly refusing to do.

Private Eye advised its readers to go into the store and get the assistant to assemble a pile of books from the most unaccessible shelves.

Then, just as the customer was about to pay, they were to casually ask for a copy of Private Eye.

When the assistant said they didn't stock it, the customer was simply to walk out, leaving the store to put all the books back on the shelves.

It must have worked :)

Another great magazine was 'Scallywag'. In the mid 90s it constantly featured the really filthy (but true) stories the mainstream press wouldn't touch with a bargepole. Does anyone else remember it?

Oh yes, but it was never in the same league as Private Eye, which exposes many surrounding political based issues, with concise factual journalism, in fact a very good example is the header for this thread.

Let's hope Private Eye follow this up with some more journalism in the manner rarely if ever projected in the local MSM.

At www.jerseyfuture.com (trying to attract yet more overpaid civil serpents) it says :

"The approach taken by the island’s media to senior public servants should be considered. Their attention can be intrusive by UK standards and requires resilience." - laughably untrue on several levels!

That cannot mean the local 'mainstream' (discredited) media, as they don't do investigative journalism.

So it means that Citizen's Media has finally been acknowledged, officially, as MEDIA :)

Advocate Stephen Baker said: "He thinks that there's a very important point that Strasbourg needs to consider; whether he's being picked upon because of his reputation rather than any other citizen, so that he's been victimised because of his previous alleged history."

And there was me thinking for one minute that Advocate Baker had at last seen the light and was referring to you, but no, sadly it was Curtis Warren!

I hope this is the tide turning and that all will be exposed for what it is from now on. That you are revered instead of being persecuted by the establishment. That the victims are acknowledged and get justice.

The evil scum who perpetrated the abuse and worse, those who covered it up, must realise that their time is running out. They should be running scared.

There is a book I strongly recommend to anyone who wants to understand just why the elites in off-shore finance centres are so protected.

"Treasure Islands: Tax Havens and the Men Who Stole the World" - by Nicholas Shaxson.

It will give any intelligent reader a real insight into why the naked lawlessness of the Jersey mafia is protected by London.

Playing such a key role in the wealth-stream of the British elites obviously brings certain advantages.

Not for nothing is the Jersey oligarchy known as a crown "protectorate".

But, hey - it isn't only the UK that's ruled by grifters.

I'm certainly going to get a copy of "Griftopia" - the new book by American writer Matt Taibbi.

This is how Wikipedia describes the book - Taibbi could be writing about Jersey's grifter oligarchy:

Deputy Le Clare made reference in the States yesterday to a group of 20 or 21 businessmen organising themselves by means of a signed code of conduct. I don't think this was a hypothetical. So that's a level playing field then. Reduce their taxes, give them lots of extra cash to use to leverage the position to exert even more control over the ordinary man's taxes.

I have been speaking to Norman Scarth that 85 year old war veteran who tried to take on Tony Bliar at Sedgefield by standing as a candidate. He has been telling me about how he was persecuted (in a similar way to how you have been treated Stuart) by Judge David Bentley QC. Now, what is interesting to me is that this is the same judge who dismissed the Operation Ore case!

I thought you might be interested to know, its funny how sometimes one bit of corruption can all tie in with another, especially when you are talking about child abuse investigations.

They will have Jersey employees - no doubt including senior mangers - who will pay tax on their earnings in Jersey.

The company however - will not be paying any income tax at all to Jersey on profits earned in the island.

If a company is owned outside of the island - then it does not pay income tax here.

It will contribute only in a very slight way - in that it will pay sales tax on things it purchases in Jersey - and its employees will pay tax - but, frankly, that's a microscopic contribution to the community when compared to the income tax lost under the Zero-10 arrangements.

Apart from the 10% taxed finance sector - a company operating in Jersey will only contribute income tax - if its actual shareholders -its owners - live in Jersey. They would then be taxed on their company's profits.

The consequences of this policy is going to be - of course - that pretty soon no business of any appreciable size is going to be owned in Jersey.

And one day we all the rest of us will be paying 40% on our fruit - and 40% income tax.

The government you deserve.

WELL, it is certainly beneficial to the working men and women of Jersey, who are currently paying about £3.30 for the cheapest pint of "dirty-sock-wash".

And "dirty-sock-wash" that only costs about 2p a pint to produce, with no tax on it, should be around 50p to the punter. Jersey breweries are just greedy pigs who have no understanding of commerce.

If your pubs are empty five days a week, you lower your prices and increase your turnover. A busy and cheaper pub will generate more customers, not less. These clowns figure that the less that people frequent their establishments, the more they put their prices up to offset the losses, the resulting outcome is that even less people will purchase from them!

Serves them right, "too good for too long" springs to mind.

Paul Stephenson, the Met police commissioner was on LBC radio. one of the subjects was missing children. The commissioner said the met police had helped with missing persons/childrens cases in jersey (I think he said it was in 2008) and that 1 missing person had been found alive.

Do you know anything about this?

As you have said so many, many times "you really could not make it up" so here we have recently TWO Jersey Advocates finding themselves in a spot of trouble...first son of crook Peter Michel, given the equivalent of an "Establishment" slap on the wrist and now we have Advocate Preston given community service and a driving ban for being THREE times over the legal alcohol limit while driving!!!. NO arrests, NO banged up in a prison cell, NO illegal search of their homes, and what really SUCKS is NO ongoing court case leading to jail. Did the facts of your own case in question lead to any danger to life and limb of any third party..NO but in Prestons case he could quite literally have killed one or more people, did he go to jail? NO, and am I right in thinking that this very Advocate had in the past something to do with the vendetta against you?. Magistrate Shaw must have really chewed her socks off thinking of the "best" way of dealing with this matter (bit like the Victoria College board when confronted with their little problem) When will the ordinary people of this Island wake up and see what a bunch of cretins are leading this Island to oblivion.

A little off subject but related to the quality of journalism and journalists.

One of the biggest stories out there at the minute is of the footballer who allegedly had an affair with the woman from Big Brother. All the national news are reporting on it but cannot name the footballer because of this "super-injunction."

We know that he has been named by Citizens Media on Twitter and possibly other Citizens Media.

Now the newspaper, the scottish Herald I believe it is, has named the footballer because I think I'm right in saying Scotland has a separate jurisdiction to England so the Super-Injunction doesn't apply there.

This is where "journalistic instinct" comes into it. Jersey has a separate jurisdiction to England also. That being the case one would believe there is an ideal opportunity, possibly a once in a lifetime opportunity for a "journalist" at the Jersey Evening Post, or indeed the Jersey Evening Post, to get recognised on the world stage for breaking a "news" story that the whole of the world are talking about.

You would think they would be falling over themselves to get this footballers name out there which, like the Scottish Herald, will receive National media attention and boost their dwindling sales.

That all said, I'm not sure that I agree the footballer should be named but from a "journalistic" point of view it's a golden opportunity for a local "journalist" to be propelled and recognised by the worlds media.

Instead of being accused of cover-ups and propaganda, which is what a lot of us believe the Jersey Evening Post is famous for, here is the ideal opportunity to make the Headlines for having the "journalistic" courage to defy the Super Rich and their gagging of the freedom of the press.

Or have I got the separate jurisdiction thing wrong?

Yes - we are a separate jurisdiction in that sense. English injunctions do not automatically apply here.

The footballer case is interesting. We all know the identity - but the English mainstream media is alone in the world in not being able to name him.

Although the specifics of the case are of zero interest to me (I've never bothered reporting the sexual activities of consenting adults, although I could have in the case of various local oligarchs) the implications of the case are fascinating.

It's a collision between the traditional law - and communication technology.

And, let's be frank - the traditional law has lost.

The big question is - for how much longer will the law and judges carry on damaging their credibility by seeking to maintain a position that is already lost?

It reminds me of the 'Spycatcher' saga. That book was available in most of the world - apart from Britain.

The difficulty, though - is that there are some legitimate cases when privacy and confidentiality are justified; just for example - protecting the identity of children. So what would happen then - if social media were to carry the massed breach of that type of confidentiality?

I haven't paid much attention to the footballer saga - but from what little I know - I really do have to wonder at the justification of the super-injunction. If such powerful legal weapons are used - and consequently discredited - on such a frankly frivolous case - what happens when a deserving case of confidentiality comes along?

There are various reasons, including protection of children, protection against blackmail. The former was the reason in the case of 'CBT' footballer.

The interesting one, which shows that the use of super-injunctions is democratically flawed, is that of Fred Goodwin. He had an affair with another top RBS executive at the time the bank was collapsing. Which job was his mind on?

Also, he had a duty to inform his employers of any such relationship because it would involve a conflict of interest. I have worked in companies where employees are separated at work if they start going out together.

Did Fred Goodwin's affair contribute to negligence at work? If he didn't inform his employers he was in breach of his contract and could potentially lose some of his 240K per year pension.

For a judge to grant a super injunction in this case was wrong, which was why it was revealed under parliamentary privilege.

There you have it...there is NO cover up over the driver of the fatal crash at Green Island. As a qualified (ex) driving instructor and having viewed the JEP photo of the disintergrated Lotus, I have to say that on the very MINIMAL scenario the driver of this vehicle was never in a month of Sundays traveling at 30mph (MAX) along this stretch of road. This tragedy happened in February and here we are in May and according to Chris Beechey [Investigations are still ongoing] b...y hell just as well it was not a murder, how b...y long does it take to conduct a traffic crash investigation? He (Beechey) states "It is a complex" case...really?...why? surely the very basic criteria are applied a)Condition of vehicle. b) Conditions of road and weather at time of accident. c)Speed of vehicle (this is realatively easy to assertain due to skid marks, impact areas etc) d) Alcohol level of driver. e)Passenger safety conditions (responsibilty of driver) i.e were seat belt's worn by all in vehicle? add nausium. Come on Chris if your department cannot ascertain what happened in this tragic incident over a lapsed time of three + months you really need to consider a change of career.The simple truth is that one way or another the driver of this vehicle will be held accountable, if not by the Jersey Court's then by his own conscience.

It is good to see the feasibility of Super-Injunctions being critically examined around the world. Professor Tony has a particularly well written post on that topic today. I have long suspected that Jersey had obtained some kind of Super-Injunction locally and throughout UK, because what bloggers have uncovered should have been of keen self interest to a great many investigative journalists. You'll probably have to look to other countries for media exposure, then, but Jersey's story is exactly the type that wins coveted press awards.

STATES chief executive Bill Ogley is to receive a six-figure pay-off when he leaves his job at the end of the month, a States Senator said yesterday.

Speaking at a Scrutiny Panel hearing yesterday Senator Jim Perchard said that both a States chief executive and a former chief officer of Health and Social Services had left their posts with ‘golden handshakes’ worth hundreds of thousands of pounds each.

He referred to one leaving with £500,000 and another with £300,000, but did not specify who had received what. It is understood, however, that the higher figures relates to Mr Ogley’s departure.

The Senator did not give names but was understood to be referring to Mr Ogley and the former chief officer of Health and Social Services Mike Pollard, who resigned in 2009

Zoompad - Yes he should because my personal feeling is that he could be successful. The tide is turning rapidly here and all to belatedly people are realising that Stuart has been right all along. Too little too late though for those who were unconvinced.

However, I can fully understand why he would not wish to do so. After all he has been subjected to by the Jersey Establishment, why would he want to stand alongside, as Stuart puts it, gangsters and spivs (with a few exceptions). I for sure would not wish it upon anybody!

Stuart will continue what he has started out to do I am certain. He does not need to sit in a festering cess-pit to do so.

Our loss, but as Stuart so often says - the Government we (do not) deserve.

There you have it...there is NO cover up over the driver of the fatal crash at Green Island. As a qualified (ex) driving instructor and having viewed the JEP photo of the disintergrated Lotus, I have to say that on the very MINIMAL scenario the driver of this vehicle was never in a month of Sundays traveling at 30mph (MAX) along this stretch of road. This tragedy happened in February and here we are in May and according to Chris Beechey [Investigations are still ongoing] b...y hell just as well it was not a murder, how b...y long does it take to conduct a traffic crash investigation? He (Beechey) states "It is a complex" case...really?...why? surely the very basic criteria are applied a)Condition of vehicle. b) Conditions of road and weather at time of accident. c)Speed of vehicle (this is realatively easy to assertain due to skid marks, impact areas etc) d) Alcohol level of driver. e)Passenger safety conditions (responsibilty of driver) i.e were seat belt's worn by all in vehicle? add nausium. Come on Chris if your department cannot ascertain what happened in this tragic incident over a lapsed time of three + months you really need to consider a change of career.The simple truth is that one way or another the driver of this vehicle will be held accountable, if not by the Jersey Court's then by his own conscience.

This is a cracker that is going round the Jersey Grapevine I have had back from numerous contacts in the know is as follows.

One the car was speeding with the top down in the rain, the damage to the car is consistent with dangerous driving.

The female passenger in the front seat did not have a seat belt on; she ended up thrown out of the car on impact and ended up face down in a puddle of water.

The driver was seen to be wondering around after suspected of being over the limit by those who saw him, the driver was seen going around with his head in his hands saying “What have I done” numerous times, and appeared to be over the limit by people who where there.

The driver has a very well know wealthy father who is or was a very high profile public figure.

The questions I ask are:

Why the driver has not being charged yet.

Why is the driver not been charged with dangerous driving at the least or possibly manslaughter?

What are the results of the breathalyser test or and, blood test. (These tests are meant to be taken from the drivers at all crashes.) If these tests have been lost or never done, one has to ask the question why, as right now it smacks of cover up.

I could say a lot having run a breakdown service for over 25 years, but all I will say right now is this case stinks and it would not surprise me in the least if this case got buried and no charges are made.

Another possible comparison for your court case Stuart,
April 24 23.30pm serious incident with car driver at Mayfair Hotel 3 very serious injuries although no deaths,driver named home address etc saturday jep 25th april 2009,in court monday 27th april 2009 speedy justice for some!!! where is the difficulty in working this one out,driver at scene of accident,witnesses by the look of it yet JEP not so keen to cover this story with the fervour of the previous incident.

I have anguished a while over this follow up mail but I feel perhaps it should be sent, it is in response to Linda Corby and her response to my mail on the St Clement tragedy. I have to say I have always been taught and led to believe that 'honesty' is the best policy in life (no doubt there are certain members of our society who will scoff at that oldy world sentiment but it has served me well) and as I said in my previous mail I find it quite incomprehensible to believe that this incident is still not resolved three + months on. The real underlying message of my first mail was simply this, right now in Poland there is a family desperately trying to come to terms with the tragic loss of their loved one (and I know how this feels from personal first hand knowledge of such a situation)and for DI Chris Beechey to say (JEP) 'Beacause of the rumours, it's almost as if people feel we should be dealing with this case differently' is quite staggering in it's crassness and insensitivety. This case IS different, a young woman has lost her life under tragic circumstances, circumstances which MUST be truthfully explained in order that her family can come to terms with her loss. To be honest I do not have the slightest interest who the driver was, but if any attempt is made to 'shield' him from the full force of the law or in any way try to reduce his responsibility for his actions on that dreadful night then we may as well not have any law at all. I have to say I find it deeply disturbing that so much effort seems to be applied to avoiding the truth in this Island (the child abuse saga being perhaps the most blatant example)Why is this the case, surely the driver of this car would be far better to face up to his actions instead of having to live with the lie for the rest of his life. Make no mistake if this driver is not charged with any offence there is something very, very wrong with the independence of the police and the rule of law and order in this Island.

Especially as I no longer put any announcements into the 'Hatched, Matched and Despatched' columns of the Raggedy Rag anymore because they kept making errors in the spelling of names and wording in my adverts and announcements. I think there must have been approx 20 years since I put any kind of announcement in that accredited media - so I have a nice pot of savings from which I could contribute to any forthcoming Jersey Justice Fund.

If a vehicle has been shipped back to manufacturers, it will likely be because someone is claiming there was a catastrophic component failure i.e. it was the manufacturer's fault not the driver's. One would expect to be able to find other reports of unexpected problems in this make of vehicle if that claim were to have any credibility.

I bet the argument about the Lotus was that it was a mechanical failure. If it was just straight insurance then 'death cars' are stored locally for a number of years(all of them!).
What is much more likely is that it was driver error with , in wet conditions, he changed down over enthusiastically from much greater than 30mph into first (not sure of the gate layout on that model) .That locked the rear wheels only ,skewing the car without scrubbing off too much speed and the inevitable consequences.

They obviously have a good lawyer on this.Which is ironic because I know another good one who did precisely this in his XJS going down Grouville Hill when tired and pushed the auto into reverse and ended up in 'the scenery',embarrased but alone and uninjured. But we won't mention that if he reads this blog, will we!

Over to you Police Chief Bowron. The Lotus incident had police measuring the skid marks ( which were excessive ) and other text book signs. This will all be in the accident report.

This will be an excellent test to see if our new police chief is indeed an honourable man like Graham Power, or was he chosen because he was weak and would bend and do what he was told by vested interest politicians and senior civil servants. ?

One of the few options the driver has to get off any charges by the team of powerful lawyers employed , is that the throttle jammed open sending the car past the speed limit, is this why the car has been shipped out to a more friendly inspectorate.

This would be quite some claim, and as a reader mentioned above this must happen to many cars of the same model especially when you look at the tragic outcome of the accident, and the possible charges that could be laid against the driver.

No one is above the law and Police Chief Bowron is there to make sure this is indeed the case. Why are the parents waiting so long for closure and what if it was his daughter ?

No that's not allowed when there has been a fatality. They are all stored in Jersey in case other legal issues arise. There are a couple of such stores with years old gruesome vehicles in there. People would be surprised when they drove around the Queens Rd. roundabout how close they were to half a dozen such cars!!

To cover the £800,000.00 payoff for Ogley & Pollard, how many sales are required to generate that amount of GST ?

My Maths isn't great but I reckon about £27,467,000.00 !!!!!

Just under £300 per person in Jersey to get rid of these clowns.

The maths. For every £103 spent £3 is GST. To take £800,000 in GST , you have to sell 800,000*103/3 pounds, which is £27,466,666.66.

Of course that calculation was a lot simpler without exemptions, and thanks to the rate going up to 5% tomorrow the good 'ol GST payer will only have to purchase £16,800,000 of goods and services to generate the same £800,000 GST!

I guess there just had to be a silver lining somewhere.

If £27,467,000 sales includes GST @ 3% this needs to be divided by 103 to firstly establish 1%.

This shows 1 % = £266,669.90. Therefore with GST @ 3%: 3 x £266,669,.90 ( 1%) = £800,009.70 (3%)

Another way of looking at it: If the Net price ex GST for someone’s Superyacht = £26,666,990 if 3% GST (£800,009.00) is added, the purchase price should = £27,466,999.00.

Hope this is right !

If I’m wrong, can anyone else show me how many sales are needed to produce £800,000.00 in cash terms ?

What complete economic madness Le Suer and Ozouf have brought on Jersey when they call themselves qualified accountants.

In the UK, I have a small property rented out and from this rent the UK inland revenue are keen to take 21% and certainly do so, on the basis the money is earned in England.

If all companies paid the 20% tax on profits earned in Jersey , GST would not be needed.

What a completely idiotic scheme thought up by Le Suer and his henchman.

To be fair to Le Suer, he was voted in as a safe pair of hands and this ridiculous scheme was already his master plan and on the table. It has worked out incredibly badly for lower and middle classes and Jersey as a whole. Tourists will go to Guernsey as there is no VAT advertised, again lost income for Jersey.

Chief Minister Le Suer, I would not trust to hold a box of a half dozen eggs or any member of the council of ministers that support him.

Your report makes interesting , easy reading but as you pointed out, the public ( taxpayers ) have a right to know how and where the £175 million budget is being spent, and that it is being spent wisely.

Mr Pollard is old but expensive news, if he and the management team were capable, then Verita would not have been employed at a cost of over £500,000 nor would our new expensive management team have been stacked above the old one.

This is where the rather good article from the JEP comes in about a Mr James Le Feuvre on the staff for twenty years. Job title strategic director with a vision of what Jerseys’ health service should look like, but never implemented. Here is the crunch.

With a very expensive well stocked management team at the hospital, Minister Anne Pryke still gave the go ahead for KPMG accountants to carry out a £760,000 review. Which really begs the question what are on earth are the large team of managers at the hospital actually achieving ?

Certainly not any “ evidence of appropriateness of spend and evidence of effectiveness and efficiency “.

Jersey shares in the inhumanity because they hid the child abuse scandal and are still hiding it today. stuart syvret done the same as Annie Yeung and he was jailed for his efforts as well. I have also heard that others have posted remarks about the Stuart Syvret issue and channel tv has cherry picked only posts they like and do not run contrary to the smooth running of "The Jersey Way. I will post this on Stuarts Syvret as well to give balance as well as complaining to my own MP about the media groups in Jersey manipulating the press.

"Councillor Ben Duncan, cabinet member for communities, equality and public protection, said that peaceful protests will be embraced by the new Green administration.

He said: "Since the election I think you can see a change of attitude at the council. We made a decision with the Spanish protests in Old Steine not to move them on and potentially inflame the situation but to allow them to demonstrate peacefully. We have had discussions with the police and they seem to be sharing that attitude."

I wrote,

Your report makes interesting , easy reading but as you pointed out, the public ( taxpayers ) have a right to know how and where the £175 million budget is being spent, and that it is being spent wisely.

The figure is wrong for 2009 the expenditure was actually £239 million, 2010 was obviously more.

Do you have any views on the latest story with health needing more money. No mention I notice of cutting back on the pen pushers.
